What is a trademark?

It is a sign used to distinguish your products and services from those of your competitors’. The trademark is one of the most powerful instruments of a business. After a successful registration, the holder is provided the exclusive right to use the mark in the relevant territory.
What is needed to file the trademark application?
In the application for registration you must include a clear presentation of the mark, list of goods and services and all the data of the applicant.
What is the length and scope of protection?
Registered trademark is protected for a 10 year period and can be renewed every 10 years. Trademarks are protected in the territory of the particular country where the registration is applied for.
Is it necessary to register a trademark?
No, there is no obligation to register your trademark.
However, you can never be sure that someone else is not intentionally or unintentionally creating something very similar.
If someone copies your trademark, it will be harder to prove that it is your trademark and harder to stop competitors.
What are the classes
of goods and services?
Goods and services are classified into 45 specific classes based on the Nice Agreement.
The list of goods of the trademark contains all those products and services which are covered by the trademark. The list of goods cannot be amended after filing the trademark application.​
In which countries should I register my trademark?
If you are planning to use your brand only locally, the application for registration should be filed with the local IPO, e.g. Latvian Patent office or UKIPO.
If you need protection in all EU countries, you should register your trade mark with the European Union Intellectual Property Office, whereas an international trade mark application must be filed with WIPO.
